1. Acceptance of Terms
These Terms of Conditions ("Terms") constitute a legally binding agreement between RiseUp Lifts ("we," "us," "our") and the client, site developer, building owner, or contractor ("Client," "you," "your"). By accessing our website, requesting a structural site consultation, or executing an agreement for elevator design, fabrication, installation, modernized upgrade, or preventive maintenance, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you are entering into these Terms on behalf of a company, partnership, or legal entity, you represent that you possess the requisite authority to bind that entity to these guidelines. If you do not agree to these terms, you must cease all engagement with our services immediately.
2. Proposals & Services
We provide advanced engineering, structural coordination, customization, and scheduled preventative and corrective maintenance programs for various types of vertical transport solutions, including passenger elevators, cargo lifts, glass panoramic cabins, home lifts, and accessibility systems.
- Validity of Proposals: All commercial bids, technical drawings, and price quotes supplied by RiseUp Lifts are valid for thirty (30) calendar days from the date of issuance, unless explicitly documented otherwise in writing.
- Scope Alteration: Any changes or modifications requested by the Client regarding the agreed passenger capacity, dimensions, cabin interior finishes, speed rating, or structural door options will necessitate a revised written proposal and a corresponding adjustment in scheduling.
3. Site Conditions & Client Duty
For new installations and modernizations, the Client holds absolute responsibility for preparing the physical host building structural shaft in strict accordance with the engineering drawings provided by RiseUp Lifts:
- Shaft Compliance: The elevator shaft must be clear, plum, clean, and dry, and possess proper concrete curing strengths, structural core clearances, overhead heights, pit depths, and secure hoisting hooks.
- Power Supply: The Client must supply and locate appropriate three-phase high-voltage power lines, circuit breakers, and standard electrical connections in the motor room or control box space, as dictated by our technical specialists.
- Safe Storage: The Client must provide a clean, secure, weatherproof storage area near the installation hoistway to house delicate elevator components (guide rails, electronic controller units, drives, and architectural panel finishes) prior to erection.
4. Payments & Billing
Payment criteria for design, custom fabrication, and structural erection services are segmented into standard project milestones to ensure uninterrupted work progress. Payment schedules are specified in each customized commercial contract. The typical payment structure is:
- Advance Order Deposit (50%): Required immediately upon sign-off of project layouts to initiate technical design review and global raw materials fabrication.
- Delivery Milestones (30%): Due immediately upon the arrival of the core elevator mechanical and electronic systems at the Client's storage or installation site.
- Handover & Testing (20%): Payable within ten (10) days after successful erection, testing, safety compliance certification, and final owner handover.
Outstanding balances not settled in accordance with these parameters will incur an interest charge of 1.5% per month, and RiseUp Lifts reserves the absolute right to halt technical work or lock vertical movement controls until payment parameters are satisfied.
5. Warranties & Liability
We pride ourselves on unmatched safety, robust engineering, and precision performance:
- Equipment Warranty: RiseUp Lifts warrants that all new elevator cabins, traction machine drives, and electronic controller systems will be free from mechanical or structural defects for a period of twelve (12) months from the date of final handover, provided the system is maintained exclusively by our certified technicians.
- Maintenance Obligations: Any unauthorized repairs, structural modifications, weight overloading, or adjustments made by third-party technicians instantly voids all equipment warranties and indemnifications.
- Limitation of Liability: RiseUp Lifts will not be liable for any indirect, consequential, punitive, or special damages (including building operational delays, loss of tenant lease revenues, or business disruptions) arising out of elevator downtime or service delays.
6. Intellectual Property
All intellectual property rights associated with our services, website, layout diagrams, custom structural designs, and software integrations belong exclusively to RiseUp Lifts:
- Drawings & Plans: Engineering drawings, core calculations, shaft wiring layouts, and computer-aided design (CAD) schematics supplied to the Client are licensed solely for the specific installation and building project. They may not be copied, distributed, shared, or adapted for any other project without our express written consent.
- Website Content: The visual layouts, photography, customized icons, text blocks, and branding elements on this Site are protected under trademark and copyright laws.
7. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms, including the evaluation of structural works, safety parameters, or invoice payments, will first be addressed through good-faith mutual consultation.
In the event that a dispute cannot be resolved through consultation within thirty (30) days, it will be referred to binding arbitration in Rawalpindi, Pakistan, under the rules of the Arbitration Act of 1940. The decision of the arbitrator will be final and binding on both parties, and the prevailing party will be entitled to recover reasonable legal fees and litigation costs.
